1. INTRODUCTION

Welcome to Indogig. This Privacy Policy ("Policy") describes how PT INDOGIG HRTECH INDONESIA ("Indogig," "we," "us," or "our") collects, uses, stores, shares, and protects the personal data of users who access and use the Indogig platform, including our website, mobile applications, and related services (collectively, the "Services").

PT INDOGIG HRTECH INDONESIA is a company focused on HR technology, registered and based at Jalan Sunset Road Tengah Building No. 9, Seminyak, Kuta, Badung, Bali, Indonesia. Indogig is officially registered in Indonesia under registration number AHU-0090431.AH.01.01.Tahun 2023 dated November 27, 2023, NIB 2911230067256, and holds Sertifikat Standar KBLI 78104 (Aktivitas Penyediaan Tenaga Kerja Lainnya) as well as TD PSE Domestik registration with the Ministry of Communication and Digital Affairs (Komdigi).

Indogig operates a workforce platform connecting businesses ("Companies") with part-time, temporary, and gig-based workers ("Workers") for shift-based work opportunities in Indonesia. Indogig acts as a technology platform that facilitates labor supply connections between Companies and Workers.

In the context of the Personal Data Protection Law No. 27 of 2022 ("UU PDP"), users of the Services are Data Subjects (Subjek Data Pribadi), and PT INDOGIG HRTECH INDONESIA acts as the Data Controller (Pengendali Data Pribadi). When Companies access Worker data through the platform, Companies act as independent Data Controllers for the data they process in connection with their own hiring and employment decisions.

By accessing or using our Services, you agree to the collection, use, retention, and disclosure of your information as described in this Policy. If you do not agree, please discontinue use of the Services.

2. INFORMATION WE COLLECT

2.1 Information You Provide Directly

For Workers (Gig Seekers):

A separate privacy notice is presented to Recommenders at the point of data collection on the recommendation web form. Recommenders are not required to read this full Policy. The data collected from Recommenders includes:

2.2 Information Collected Automatically

When you use our Services, we may automatically collect:

  • Device Information: Device type, operating system, unique device identifiers, mobile network information
  • Log Data: IP address, browser type and version, pages visited, timestamps, time spent on pages
  • Usage Data: Navigation paths, feature interactions, search queries, app usage patterns
  • Location Data: General location derived from IP address or device settings (we do not use precise GPS tracking)

2.3 Information from Third Parties

  • WhatsApp OTP verification: We use the WhatsApp Business API (provided by Meta Platforms, Inc., headquartered in the United States) to send One-Time Password (OTP) codes for account registration and identity verification. Your phone number is transmitted to Meta's servers for this purpose. Please refer to Meta's Privacy Policy for information on how Meta handles this data.
  • Telegram notifications: Internal administrative notifications are sent via Telegram (operated by Telegram FZE, Dubai) for operational purposes (new registrations, document submissions, payment requests). Only minimal data is included (e.g., "New worker registered" with a name — no bank details, no phone numbers, no document contents). This constitutes a cross-border data transfer; see Section 11.

3. LEGAL BASIS FOR PROCESSING

Under UU PDP Art. 20, we process your personal data based on the following legal grounds:

Where processing is based on consent, you may withdraw consent at any time (see Section 9). Withdrawal does not affect the lawfulness of processing before withdrawal but may limit your ability to use certain features of the Services.

4. HOW WE USE YOUR INFORMATION

4.1 Core Platform Operations

  • Account creation and authentication — registering accounts and verifying identity via WhatsApp OTP
  • Profile management — building and maintaining Worker and Company profiles, calculating Profile Strength
  • Job matching — connecting Workers with relevant shift opportunities based on skills, location, and preferences; Profile Strength scoring affects Worker visibility in Company search results
  • Shift management — facilitating the process of applying for, hiring, checking in/out, and completing shifts
  • Payment processing — managing Company balance top-ups, Worker payment disbursements, and maintaining financial records
  • Document verification — reviewing and approving/rejecting Worker-submitted CVs and video presentations
  • Recommendation system — enabling Workers to collect and display verified professional references
  • Rating and reputation — calculating and displaying Worker ratings, completion rates, and reliability indicators

4.2 Communication

  • Sending notifications about application status, shift updates, and payment confirmations
  • Communicating platform updates, policy changes, and service announcements
  • Responding to support requests and inquiries

4.3 Platform Improvement

  • Analyzing usage patterns and trends to improve platform functionality
  • Conducting research and analysis to develop new features
  • Monitoring and preventing fraud, abuse, and security threats

4.4 Legal Compliance

  • Complying with applicable Indonesian laws and regulations, including labor laws (UU 13/2003, UU Cipta Kerja), tax regulations, and data protection requirements (UU PDP No. 27/2022)
  • Responding to lawful requests from government authorities and courts
  • Protecting our rights, property, and the safety of our users

5. HOW WE SHARE YOUR INFORMATION

5.1 Between Platform Users

  • Worker profiles (including name, photo, work experience, verified documents, recommendations, rating, Profile Strength, and reliability indicators) are visible to Companies when reviewing applications and hiring for shifts.
  • Company information (including company name, type, location, and job details) is visible to Workers when browsing and applying for available shifts.
  • Recommender information is displayed on the Worker's profile as part of their professional references, subject to the Worker's control (Workers may show, hide, or delete recommendations).

5.2 With Service Providers (Data Processors)

We engage trusted third-party Data Processors (Prosesor Data Pribadi) who assist us in operating the platform. We maintain Data Processing Agreements (Perjanjian Pemrosesan Data) with each processor in accordance with UU PDP Art. 35. These processors include:

These providers are contractually obligated to protect your data, use it solely for the purposes of delivering services to us, and comply with data protection standards equivalent to those required by UU PDP.

5.3 For Legal Purposes

We may disclose your information when required by law, regulation, or legal process, or when we believe in good faith that disclosure is necessary to:

  • Comply with applicable laws or respond to valid government requests (including requests under PP 71/2019 Art. 21)
  • Protect the rights, property, or safety of Indogig, our users, or the public
  • Detect and prevent fraud, security threats, or technical issues

5.4 Business Transfers

In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any such change at least 30 days in advance and inform you of any choices you may have regarding your information, including the right to delete your account.

5.5 What We Do NOT Share

  • We do not sell your personal data to third parties.
  • We do not share your data with advertisers for targeted advertising without your explicit consent.
  • We do not share Worker bank account or e-wallet details with Companies. Financial data is used solely by Indogig's administration for payment disbursement.

6. SELFIE AND PHOTO DATA (SPECIFIC PERSONAL DATA)

Selfie photos and video presentations are classified as Specific Personal Data (Data Pribadi yang Bersifat Spesifik) under UU PDP Art. 4(2), as they contain biometric-capable facial data. We apply heightened protections to this data:

6.1 Check-in and Check-out Selfies

As part of our shift verification system, Workers are required to take selfie photos during check-in (before the shift begins) and check-out (after the shift ends). Separate explicit consent is collected at the point of first selfie capture. These photos:

  • Are used solely for attendance verification and shift time tracking
  • Are viewable by the Company that posted the shift and by Indogig administrators
  • Are stored securely with access controls limiting who can view them
  • Are retained for 3 years from the shift date (see Section 7)
  • Are not used for facial recognition technology, biometric profiling, surveillance, or any purpose other than attendance verification
  • May be used as evidence in payment or attendance disputes between Companies and Workers

6.2 Profile Photos and Video Presentations

  • Profile photos uploaded during onboarding are displayed on your Worker profile and are visible to Companies
  • Video self-presentations (up to 1 minute) are reviewed by Indogig administrators for quality and appropriateness, and may be viewable by Companies as part of the Worker's profile
  • Separate explicit consent is collected when you first upload a video presentation
  • You may update, replace, or delete your profile photo and video at any time through the app

7. DATA RETENTION

We retain your personal data only for as long as necessary to fulfill the purposes described in this Policy, comply with our legal obligations, resolve disputes, and enforce our agreements.

After the applicable retention period, data will be securely deleted or anonymized. If you delete your account, we will remove your personal data within a reasonable timeframe, subject to any legal retention obligations.

8. DATA SECURITY

We implement industry-standard security measures to protect your personal data, including:

  • Encryption of data in transit (TLS/SSL) and at rest
  • Secure server infrastructure with access controls
  • Regular security audits and vulnerability assessments
  • Employee and contractor access limited to need-to-know basis
  • Secure handling of payment-related information
  • Specific Personal Data (selfies, videos) stored with additional access restrictions

Despite our efforts, no method of electronic transmission or storage is 100% secure. You are responsible for:

  • Maintaining the confidentiality of your account password
  • Not sharing your OTP codes with anyone
  • Ensuring the security of the device you use to access our Services
  • Reporting any suspected unauthorized access to your account immediately to info@indogig.com

9. YOUR RIGHTS

Under UU PDP No. 27/2022, you have the following rights as a Data Subject (Subjek Data Pribadi):

  • Right to Information (Art. 5-7): Be informed about the identity of the Data Controller, the legal basis for processing, the purpose of processing, and the retention period
  • Right to Access (Art. 8): Request a copy of the personal data we hold about you
  • Right to Correction (Art. 8): Request correction of inaccurate or incomplete data
  • Right to Deletion (Art. 8): Request deletion of your personal data, subject to legal retention requirements
  • Right to Restrict Processing (Art. 10): Request that we limit the processing of your data in certain circumstances
  • Right to Data Portability (Art. 12): Request a copy of your data in a structured, commonly used, and machine-readable format
  • Right to Withdraw Consent (Art. 9): Withdraw your consent to data processing at any time (this will not affect the lawfulness of processing before withdrawal)
  • Right to Object (Art. 11): Object to the processing of your data based on legitimate interest or for direct marketing purposes
  • Right to Explanation of Automated Decisions (Art. 27): Request an explanation of automated processing that significantly affects you, including Profile Strength scoring and job matching algorithms that affect your access to job opportunities

To exercise any of these rights, contact our Data Protection Officer at info@indogig.com. We will respond to your request without undue delay, and in any event within 30 days. We may require verification of your identity before processing your request.

If your request is denied (in whole or in part), we will provide a written explanation of the reasons. You have the right to lodge a complaint with the supervisory authority responsible for personal data protection under UU PDP Art. 58-60.

We do not discriminate against users who exercise their privacy rights.

10. DATA BREACH NOTIFICATION

In accordance with UU PDP Art. 46, in the event of a personal data breach that affects your data, we will:

  1. Notify the supervisory authority (Komdigi) within 3 x 24 hours of discovering the breach, providing: a description of the breach, the types of data affected, the number of data subjects affected, and the measures taken to address and mitigate the breach.
  2. Notify affected Data Subjects within the same timeframe via the communication channels available to us (email, in-app notification, or phone), providing: a description of the breach, the types of your data affected, and recommended protective measures you can take.

11. INTERNATIONAL DATA TRANSFERS

Your information is primarily stored and processed on servers operated by our cloud hosting provider, which may be located outside of Indonesia (currently in the United States). Additionally, your phone number is transmitted to Meta (US) for WhatsApp OTP verification, and minimal operational data is transmitted via Telegram (Dubai).

In accordance with UU PDP Art. 56, we ensure that:

  • The receiving countries or organizations provide a level of personal data protection equivalent to that required by UU PDP
  • We maintain binding Data Processing Agreements with all overseas processors
  • Appropriate contractual safeguards (including standard contractual clauses) are in place
  • We will inform you if the data protection standard in a receiving country changes materially

By using our Services, you consent to the transfer of your data to these jurisdictions as described in this section. You may withdraw consent for non-essential transfers by contacting info@indogig.com, though this may limit your ability to use the Services.

12. COOKIES AND TRACKING TECHNOLOGIES

We may use cookies and similar tracking technologies on our website and applications to:

  • Essential cookies: Maintain your login session and ensure the platform functions correctly (no consent required)
  • Analytics cookies: Understand how users interact with our Services and improve platform performance (consent required)

We do not use marketing or advertising cookies. You can manage cookie preferences through your browser or device settings. Disabling essential cookies may prevent you from using the Services.

13. CHILDREN'S PRIVACY

Our Services are not intended for individuals under the age of 18. We do not knowingly collect personal data from children under 18. If we become aware that we have collected data from a person under 18 without appropriate consent, we will take steps to delete such information promptly.

Workers must be at least 18 years of age to register on the platform. See the Terms of Use for age requirements and any exceptions for Workers aged 15-17 with parental consent and additional safeguards, in accordance with UU Ketenagakerjaan No. 13/2003 Art. 68-69.

14. THIRD-PARTY LINKS AND SERVICES

Our Services may contain links to third-party websites or services. We are not responsible for the privacy practices of these third parties. We encourage you to review the privacy policies of any third-party services before providing your personal data.

Communication between users conducted outside our platform (e.g., via WhatsApp, phone calls, or other channels) is not covered by this Policy. Users are responsible for any personal data shared outside the Indogig platform.

15. CHANGES TO THIS POLICY

We may update this Privacy Policy from time to time. When we make significant changes, we will:

  • Update the "Last modified" date at the top of this Policy
  • Notify users through the Services or via email at least 30 days before the changes take effect
  • For material changes affecting legal basis or data categories, seek fresh explicit consent where required

Your continued use of the Services after the updated Policy takes effect constitutes your acceptance of the changes. If you do not agree with the changes, you may delete your account and discontinue use of the Services.

Dalam konteks Undang-Undang Perlindungan Data Pribadi No. 27 Tahun 2022 ("UU PDP"), pengguna Layanan merupakan Subjek Data Pribadi, dan PT INDOGIG HRTECH INDONESIA bertindak sebagai Pengendali Data Pribadi. Apabila Perusahaan mengakses data Pekerja melalui platform, Perusahaan bertindak sebagai Pengendali Data Pribadi yang independen untuk data yang mereka proses sehubungan dengan keputusan perekrutan dan ketenagakerjaan mereka sendiri.

Dengan mengakses atau menggunakan Layanan kami, Anda menyetujui pengumpulan, penggunaan, penyimpanan, dan pengungkapan informasi Anda sebagaimana dijelaskan dalam Kebijakan ini. Jika Anda tidak setuju, silakan hentikan penggunaan Layanan.

2.2 Informasi yang Dikumpulkan Secara Otomatis

Saat Anda menggunakan Layanan kami, kami dapat secara otomatis mengumpulkan:

  • Informasi Perangkat: Jenis perangkat, sistem operasi, pengenal perangkat unik, informasi jaringan seluler
  • Data Log: Alamat IP, jenis dan versi browser, halaman yang dikunjungi, cap waktu, waktu yang dihabiskan di halaman
  • Data Penggunaan: Jalur navigasi, interaksi fitur, kueri pencarian, pola penggunaan aplikasi
  • Data Lokasi: Lokasi umum yang diperoleh dari alamat IP atau pengaturan perangkat (kami tidak menggunakan pelacakan GPS secara presisi)

2.3 Informasi dari Pihak Ketiga

  • Verifikasi OTP WhatsApp: Kami menggunakan WhatsApp Business API (disediakan oleh Meta Platforms, Inc., berkedudukan di Amerika Serikat) untuk mengirim kode One-Time Password (OTP) untuk pendaftaran akun dan verifikasi identitas. Nomor telepon Anda dikirimkan ke server Meta untuk tujuan ini. Silakan merujuk pada Kebijakan Privasi Meta untuk informasi tentang bagaimana Meta menangani data ini.
  • Notifikasi Telegram: Notifikasi administratif internal dikirim melalui Telegram (dioperasikan oleh Telegram FZE, Dubai) untuk tujuan operasional (pendaftaran baru, pengiriman dokumen, permintaan pembayaran). Hanya data minimal yang disertakan (misalnya, "Pekerja baru terdaftar" dengan nama — tanpa detail bank, tanpa nomor telepon, tanpa isi dokumen). Ini merupakan transfer data lintas batas; lihat Bagian 11.

3. DASAR HUKUM PEMROSESAN

Berdasarkan UU PDP Pasal 20, kami memproses data pribadi Anda berdasarkan dasar hukum berikut:

Apabila pemrosesan didasarkan pada persetujuan, Anda dapat menarik persetujuan kapan saja (lihat Bagian 9). Penarikan tidak mempengaruhi keabsahan pemrosesan sebelum penarikan, tetapi dapat membatasi kemampuan Anda untuk menggunakan fitur-fitur tertentu dari Layanan.

4. BAGAIMANA KAMI MENGGUNAKAN INFORMASI ANDA

4.1 Operasi Inti Platform

  • Pembuatan dan autentikasi akun — mendaftarkan akun dan memverifikasi identitas melalui WhatsApp OTP
  • Manajemen profil — membangun dan memelihara profil Pekerja dan Perusahaan, menghitung Profile Strength
  • Pencocokan pekerjaan — menghubungkan Pekerja dengan peluang shift yang relevan berdasarkan keterampilan, lokasi, dan preferensi; skor Profile Strength mempengaruhi visibilitas Pekerja dalam hasil pencarian Perusahaan
  • Manajemen shift — memfasilitasi proses melamar, mempekerjakan, check-in/out, dan menyelesaikan shift
  • Pemrosesan pembayaran — mengelola pengisian saldo Perusahaan, pencairan pembayaran Pekerja, dan memelihara catatan keuangan
  • Verifikasi dokumen — meninjau dan menyetujui/menolak CV dan video presentasi yang dikirimkan Pekerja
  • Sistem rekomendasi — memungkinkan Pekerja mengumpulkan dan menampilkan referensi profesional yang terverifikasi
  • Rating dan reputasi — menghitung dan menampilkan rating Pekerja, tingkat penyelesaian, dan indikator keandalan

4.2 Komunikasi

  • Mengirim notifikasi tentang status lamaran, pembaruan shift, dan konfirmasi pembayaran
  • Mengkomunikasikan pembaruan platform, perubahan kebijakan, dan pengumuman layanan
  • Merespons permintaan dukungan dan pertanyaan

4.3 Peningkatan Platform

  • Menganalisis pola dan tren penggunaan untuk meningkatkan fungsionalitas platform
  • Melakukan riset dan analisis untuk mengembangkan fitur baru
  • Memantau dan mencegah penipuan, penyalahgunaan, dan ancaman keamanan

4.4 Kepatuhan Hukum

  • Mematuhi hukum dan peraturan Indonesia yang berlaku, termasuk hukum ketenagakerjaan (UU 13/2003, UU Cipta Kerja), peraturan perpajakan, dan persyaratan perlindungan data pribadi (UU PDP No. 27/2022)
  • Merespons permintaan sah dari otoritas pemerintah dan pengadilan (termasuk permintaan berdasarkan PP 71/2019 Pasal 21)
  • Melindungi hak, properti, dan keselamatan pengguna kami

5. BAGAIMANA KAMI MEMBAGIKAN INFORMASI ANDA

5.1 Antar Pengguna Platform

  • Profil Pekerja (termasuk nama, foto, pengalaman kerja, dokumen terverifikasi, rekomendasi, rating, Profile Strength, dan indikator keandalan) dapat dilihat oleh Perusahaan saat meninjau lamaran dan merekrut untuk shift.
  • Informasi Perusahaan (termasuk nama perusahaan, jenis, lokasi, dan detail pekerjaan) dapat dilihat oleh Pekerja saat menelusuri dan melamar shift yang tersedia.
  • Informasi Pemberi Rekomendasi ditampilkan di profil Pekerja sebagai bagian dari referensi profesional, tunduk pada kontrol Pekerja (Pekerja dapat menampilkan, menyembunyikan, atau menghapus rekomendasi).

5.2 Dengan Penyedia Layanan (Prosesor Data Pribadi)

Kami melibatkan Prosesor Data Pribadi pihak ketiga yang tepercaya untuk membantu mengoperasikan platform. Kami memelihara Perjanjian Pemrosesan Data dengan setiap prosesor sesuai dengan UU PDP Pasal 35. Prosesor ini meliputi:

Penyedia ini diwajibkan secara kontraktual untuk melindungi data Anda, menggunakannya semata-mata untuk tujuan penyediaan layanan kepada kami, dan mematuhi standar perlindungan data yang setara dengan yang disyaratkan oleh UU PDP.

5.3 Untuk Tujuan Hukum

Kami dapat mengungkapkan informasi Anda bila diwajibkan oleh hukum, peraturan, atau proses hukum, atau bila kami percaya dengan itikad baik bahwa pengungkapan diperlukan untuk:

  • Mematuhi hukum yang berlaku atau merespons permintaan pemerintah yang sah (termasuk permintaan berdasarkan PP 71/2019 Pasal 21)
  • Melindungi hak, properti, atau keselamatan Indogig, pengguna kami, atau masyarakat
  • Mendeteksi dan mencegah penipuan, ancaman keamanan, atau masalah teknis

5.4 Pengalihan Bisnis

Dalam hal terjadi penggabungan, akuisisi, reorganisasi, atau penjualan aset, informasi Anda dapat dialihkan sebagai bagian dari transaksi tersebut. Kami akan memberitahu Anda tentang perubahan tersebut setidaknya 30 hari sebelumnya dan menginformasikan pilihan yang Anda miliki terkait informasi Anda, termasuk hak untuk menghapus akun Anda.

5.5 Yang TIDAK Kami Bagikan

  • Kami tidak menjual data pribadi Anda kepada pihak ketiga.
  • Kami tidak membagikan data Anda kepada pengiklan untuk iklan bertarget tanpa persetujuan eksplisit Anda.
  • Kami tidak membagikan detail rekening bank atau e-wallet Pekerja kepada Perusahaan. Data keuangan hanya digunakan oleh administrasi Indogig untuk pencairan pembayaran.

6. DATA SELFIE DAN FOTO (DATA PRIBADI YANG BERSIFAT SPESIFIK)

Foto selfie dan video presentasi diklasifikasikan sebagai Data Pribadi yang Bersifat Spesifik berdasarkan UU PDP Pasal 4 ayat (2), karena mengandung data wajah yang bersifat biometrik. Kami menerapkan perlindungan yang ditingkatkan terhadap data ini:

6.1 Selfie Check-in dan Check-out

Sebagai bagian dari sistem verifikasi shift, Pekerja diwajibkan mengambil foto selfie saat check-in dan check-out. Persetujuan eksplisit terpisah dikumpulkan pada saat pengambilan selfie pertama. Foto-foto ini:

  • Digunakan semata-mata untuk verifikasi kehadiran dan pelacakan waktu shift
  • Dapat dilihat oleh Perusahaan yang memasang shift dan oleh administrator Indogig
  • Disimpan dengan aman dengan kontrol akses yang membatasi siapa yang dapat melihatnya
  • Disimpan selama 3 tahun dari tanggal shift (lihat Bagian 7)
  • Tidak digunakan untuk teknologi pengenalan wajah, profiling biometrik, pengawasan, atau tujuan lain selain verifikasi kehadiran
  • Dapat digunakan sebagai bukti dalam sengketa pembayaran atau kehadiran antara Perusahaan dan Pekerja

6.2 Foto Profil dan Video Presentasi

  • Foto profil yang diunggah selama onboarding ditampilkan di profil Pekerja dan dapat dilihat oleh Perusahaan
  • Video presentasi diri (maksimal 1 menit) ditinjau oleh administrator Indogig untuk kualitas dan kelayakan, dan dapat dilihat oleh Perusahaan sebagai bagian dari profil Pekerja
  • Persetujuan eksplisit terpisah dikumpulkan saat Anda pertama kali mengunggah video presentasi
  • Anda dapat memperbarui, mengganti, atau menghapus foto profil dan video kapan saja melalui aplikasi

7. PENYIMPANAN DATA

Kami menyimpan data pribadi Anda hanya selama diperlukan untuk memenuhi tujuan yang dijelaskan dalam Kebijakan ini, mematuhi kewajiban hukum kami, menyelesaikan sengketa, dan menegakkan perjanjian kami.

Setelah periode penyimpanan yang berlaku, data akan dihapus secara aman atau dianonimkan. Jika Anda menghapus akun Anda, kami akan menghapus data pribadi Anda dalam jangka waktu yang wajar, dengan tunduk pada kewajiban penyimpanan hukum yang berlaku.

8. KEAMANAN DATA

Kami menerapkan langkah-langkah keamanan standar industri untuk melindungi data pribadi Anda, termasuk:

  • Enkripsi data dalam transit (TLS/SSL) dan saat disimpan
  • Infrastruktur server yang aman dengan kontrol akses
  • Audit keamanan dan penilaian kerentanan secara berkala
  • Akses karyawan dan kontraktor dibatasi berdasarkan kebutuhan
  • Penanganan informasi pembayaran yang aman
  • Data Pribadi yang Bersifat Spesifik (selfie, video) disimpan dengan pembatasan akses tambahan

Meskipun demikian, tidak ada metode transmisi atau penyimpanan elektronik yang 100% aman. Anda bertanggung jawab untuk:

  • Menjaga kerahasiaan kata sandi akun Anda
  • Tidak membagikan kode OTP Anda kepada siapa pun
  • Memastikan keamanan perangkat yang Anda gunakan untuk mengakses Layanan kami
  • Segera melaporkan dugaan akses tidak sah ke akun Anda ke info@indogig.com

9. HAK-HAK ANDA

Berdasarkan UU PDP No. 27 Tahun 2022, Anda memiliki hak-hak berikut sebagai Subjek Data Pribadi:

  • Hak atas Informasi (Pasal 5-7): Mendapatkan informasi tentang identitas Pengendali Data Pribadi, dasar hukum pemrosesan, tujuan pemrosesan, dan periode penyimpanan
  • Hak Akses (Pasal 8): Meminta salinan data pribadi yang kami simpan tentang Anda
  • Hak Koreksi (Pasal 8): Meminta perbaikan data yang tidak akurat atau tidak lengkap
  • Hak Penghapusan (Pasal 8): Meminta penghapusan data pribadi Anda, tunduk pada kewajiban penyimpanan hukum
  • Hak Pembatasan Pemrosesan (Pasal 10): Meminta pembatasan pemrosesan data Anda dalam keadaan tertentu
  • Hak Portabilitas Data (Pasal 12): Meminta salinan data Anda dalam format yang terstruktur, umum digunakan, dan dapat dibaca mesin
  • Hak Penarikan Persetujuan (Pasal 9): Menarik persetujuan Anda untuk pemrosesan data kapan saja (tidak mempengaruhi keabsahan pemrosesan sebelum penarikan)
  • Hak Keberatan (Pasal 11): Menolak pemrosesan data Anda berdasarkan kepentingan sah atau untuk tujuan pemasaran langsung
  • Hak atas Penjelasan Keputusan Otomatis (Pasal 27): Meminta penjelasan tentang pemrosesan otomatis yang secara signifikan mempengaruhi Anda, termasuk skor Profile Strength dan algoritma pencocokan pekerjaan

Untuk menggunakan hak-hak ini, hubungi Pejabat Pelindungan Data Pribadi kami di info@indogig.com. Kami akan merespons permintaan Anda tanpa penundaan yang tidak semestinya, dan dalam hal apa pun dalam waktu 30 hari. Kami dapat memerlukan verifikasi identitas Anda sebelum memproses permintaan Anda.

Jika permintaan Anda ditolak (seluruhnya atau sebagian), kami akan memberikan penjelasan tertulis tentang alasannya. Anda berhak mengajukan keluhan kepada lembaga pengawas yang bertanggung jawab atas perlindungan data pribadi berdasarkan UU PDP Pasal 58-60.

Kami tidak mendiskriminasi pengguna yang menggunakan hak privasi mereka.

10. PEMBERITAHUAN PELANGGARAN DATA

Sesuai dengan UU PDP Pasal 46, dalam hal terjadi pelanggaran data pribadi yang mempengaruhi data Anda, kami akan:

  1. Memberitahu lembaga pengawas (Komdigi) dalam waktu 3 x 24 jam sejak ditemukannya pelanggaran, menyediakan: deskripsi pelanggaran, jenis data yang terpengaruh, jumlah Subjek Data Pribadi yang terpengaruh, dan langkah-langkah yang diambil untuk mengatasi dan memitigasi pelanggaran.
  2. Memberitahu Subjek Data Pribadi yang terpengaruh dalam jangka waktu yang sama melalui saluran komunikasi yang tersedia bagi kami (email, notifikasi dalam aplikasi, atau telepon), menyediakan: deskripsi pelanggaran, jenis data Anda yang terpengaruh, dan langkah-langkah perlindungan yang disarankan yang dapat Anda ambil.

11. TRANSFER DATA INTERNASIONAL

Informasi Anda terutama disimpan dan diproses di server yang dioperasikan oleh penyedia hosting cloud kami, yang mungkin berlokasi di luar Indonesia (saat ini di Amerika Serikat). Selain itu, nomor telepon Anda dikirimkan ke Meta (AS) untuk verifikasi WhatsApp OTP, dan data operasional minimal dikirimkan melalui Telegram (Dubai).

Sesuai dengan UU PDP Pasal 56, kami memastikan bahwa:

  • Negara atau organisasi penerima menyediakan tingkat perlindungan data pribadi yang setara dengan yang disyaratkan oleh UU PDP
  • Kami memelihara Perjanjian Pemrosesan Data yang mengikat dengan semua prosesor di luar negeri
  • Perlindungan kontraktual yang memadai (termasuk klausul kontraktual standar) telah diterapkan
  • Kami akan menginformasikan Anda jika standar perlindungan data di negara penerima berubah secara material

Dengan menggunakan Layanan kami, Anda menyetujui transfer data Anda ke yurisdiksi-yurisdiksi ini sebagaimana dijelaskan dalam bagian ini. Anda dapat menarik persetujuan untuk transfer yang tidak esensial dengan menghubungi info@indogig.com, meskipun hal ini dapat membatasi kemampuan Anda untuk menggunakan Layanan.

12. COOKIE DAN TEKNOLOGI PELACAKAN

Kami dapat menggunakan cookie dan teknologi pelacakan serupa di situs web dan aplikasi kami untuk:

  • Cookie esensial: Memelihara sesi login Anda dan memastikan platform berfungsi dengan benar (tidak memerlukan persetujuan)
  • Cookie analitik: Memahami bagaimana pengguna berinteraksi dengan Layanan kami dan meningkatkan kinerja platform (memerlukan persetujuan)

Kami tidak menggunakan cookie pemasaran atau periklanan. Anda dapat mengelola preferensi cookie melalui pengaturan browser atau perangkat Anda. Menonaktifkan cookie esensial dapat mencegah Anda menggunakan Layanan.

13. PRIVASI ANAK

Layanan kami tidak ditujukan untuk individu di bawah usia 18 tahun. Kami tidak secara sadar mengumpulkan data pribadi dari anak di bawah 18 tahun. Jika kami mengetahui bahwa kami telah mengumpulkan data dari seseorang di bawah 18 tahun tanpa persetujuan yang memadai, kami akan segera mengambil langkah untuk menghapus informasi tersebut.

Pekerja harus berusia minimal 18 tahun untuk mendaftar di platform. Lihat Ketentuan Penggunaan untuk persyaratan usia dan pengecualian bagi Pekerja usia 15-17 tahun dengan persetujuan orang tua dan perlindungan tambahan, sesuai dengan UU Ketenagakerjaan No. 13/2003 Pasal 68-69.

14. TAUTAN DAN LAYANAN PIHAK KETIGA

Layanan kami mungkin berisi tautan ke situs web atau layanan pihak ketiga. Kami tidak bertanggung jawab atas praktik privasi pihak ketiga tersebut. Kami mendorong Anda untuk meninjau kebijakan privasi layanan pihak ketiga sebelum memberikan data pribadi Anda.

Komunikasi antar pengguna yang dilakukan di luar platform kami (misalnya melalui WhatsApp, panggilan telepon, atau saluran lainnya) tidak tercakup oleh Kebijakan ini. Pengguna bertanggung jawab atas data pribadi yang dibagikan di luar platform Indogig.

15. PERUBAHAN KEBIJAKAN INI

Kami dapat memperbarui Kebijakan Privasi ini dari waktu ke waktu. Saat kami melakukan perubahan signifikan, kami akan:

  • Memperbarui tanggal "Terakhir diubah" di bagian atas Kebijakan ini
  • Memberitahu pengguna melalui Layanan atau email setidaknya 30 hari sebelum perubahan berlaku
  • Untuk perubahan material yang mempengaruhi dasar hukum atau kategori data, meminta persetujuan eksplisit baru bila diperlukan

Penggunaan Layanan yang berkelanjutan setelah Kebijakan yang diperbarui berlaku merupakan penerimaan Anda terhadap perubahan tersebut. Jika Anda tidak setuju dengan perubahan, Anda dapat menghapus akun Anda dan menghentikan penggunaan Layanan.
